Not true. Even in states with ages of consent higher than 16 (like LA) there is a difference between "carnal knowledge of a juvenile with consent" and actual rape.

So now we learn that there is a medical examination confirming that the daughter was raped.

I always wonder, at moments like this, whether people who previously gave excuses for the scumbag will
  1. Continue to do so
  2. Decide this is bad for the daughter, but continue to think they were justified and did no harm in previously accusing the mother of lying
  3. Have a wholly new outlook on the matter, as if their first reaction never happened

    Or

  4. Actually reflect on their first reaction and decide it was regrettable.

In January 2021, the child's school counselor notified the Department of Children and Family Services that the girl alleged Barnes physically and mentally abused her. In February 2022, court documents noted for the first time that their daughter was conceived by rape, and it was alleged that Barnes drugged and sexually assaulted his daughter.

“She was transported to New Orleans where she was evaluated and the doctor confirmed that there was evidence of forced entry congruent with sexual assault,” the document read.

Also, it "currently" didn't work this way for the woman. She has been sharing custody with her rapist for over a decade now.

I agree.

Furthermore, could it also be allowed this guy being guilty of the statutory rape... yet still be awarded custody since the child actually wants to live with him? Aren't the views of the child always supposed to be above everything else on the judgement?

Assuming the aforementioned, current child support from the woman does not seem so incredible anymore.

I did not say she in particular did (although she might have - no way to know 16 years later one way or the other).
I was talking generally that this is an aspect of these laws that I find particularly egregious - they do not allow the other party lying about her age as a defense.

I have it on good authority that while young men may not be able to tell if a girl is under age by looking at her, they are pretty easily able to tell if they talk to her.
