"This past June, three Santa Ana police officers were suspended after a video surfaced of them joking about kicking a woman in a wheelchair “in the fucking nub” and eating (what appears to be) weed-infused edibles during a raid of a medical marijuana dispensary. And now, those same cops want to ban that video from ever becoming evidence—because they didn’t realize they were on camera."

Would that work for my traffic ticket? I wouldn't have run the red light if i'd realized they installed a camera on that intersection.
There weren't any cops around to witness my infraction, or I wouldn't have done it.

Would the cops accept this defense? Didn't realize there was objective evidence against me, no harm, no foul?
 
Yeah, it's kind of a silly defense. I guess if I was caught destroying and stealing evidence and consuming illegal drugs while on duty, I would desperately cling to whatever defense I could muster.
 
The police were in a public place doing their job. What privacy are they talking about?
