Starting a new thread for the judicial proceedings against the insurrectionists.

First up is Jacob Anthony Chansley aka Jacob Angeli aka QAnon Shaman.

He is being tried in DC, and this is the Indictment.

That just lists the basics of the 6 charges: civil disorder, obstruction of an official proceeding, entry and remaining in a restricted building, disorderly and disruptive conduct in a restricted building, violent entry and disorderly conduct in a Capitol building, parading, demonstrating, or picketing in a Capitol building.

But the US attorney yesterday filed a brief in support of detaining Angeli which has more detail.

GOVERNMENT’S BRIEF IN SUPPORT OF DETENTION

It is quite a read, most of the 17 pages is arguing why he's a flight risk, but it also goes into details of what he did at the Capitol and how explicitly he admitted during that he was there to overthrow the government, and how he wanted to come back for the inauguration. Here are some excerpts. It starts out,

For the reasons set forth below, the Court should order Chansley to be detained pending trial. Chansley is an active participant in—and has made himself the most prominent symbol of—a violent insurrection that attempted to overthrow the United States Government on January 6, 2021. Chansley has expressed interest in returning to Washington, D.C. for President-Elect Biden’s inauguration and has the ability to do so if the Court releases him.

It says he was carrying a weapon, which makes the charges worse. His flagpole was a spear, the document includes photos within the text (nice how they can do that now).

Chansley approached Officer Robishaw and screamed, among other things, that this was their house, and that they were there to take the Capitol, and to get Congressional leaders. Chansley also used his bullhorn to communicate that they were there to take out several United States congressmen.

He even left a threatening note for Pence.

Officer Robishaw, alone with more than 25 rioters in the Senate Chamber, attempted to engage with Chansley and asked for his assistance to use the bullhorn to get the protestors out of the Chamber. Instead of doing so, Chansley ran up on the dais where Vice President Pence had been presiding just minutes before, and begin posing on the dais for other rioters to document and photograph, and wrote a note to Vice President Pence saying, “it's only a matter of time, justice is coming.”

He actually called the FBI to confess.

On January 7, 2021, Chansley called the Washington Field Office of the FBI and requested to speak with law enforcement. Chansley confessed that he was the man photographed at Vice President Pence’s chair on the Senate dais, face painted, carrying the spear and wearing a horned helmet. He said that he was able to get into the United States Senate in D.C. “by the grace of God.”

How he bragged to media about the attack.

“The fact that we had a bunch of our traitors in office hunker down, put on their gas masks and retreat into their underground bunker, I consider that a win,” Chansley said. Chansley stated that he drove to Washington, D.C. as a part of a group effort, with other “patriots” from Arizona, at the request of the President that all “patriots” come to D.C. on January 6, 2021.

He planned to go to the AZ Capitol next.

Twice, Chansley told the FBI that he had plans after the January 9 FBI interview to drive to the Arizona State Capitol. Corroborating his statement, Chansley had his horns, furry coyote tail headdress, face paint, tan pants, sixfoot-long spear, and his bullhorn inside the 2003 Hyundai that he parked at the FBI.

Some on why he is a flight risk.

Chansley also stated he has no mental health conditions, but publicly-available information and videos reveal a very different picture. Chansley has spoken openly about his belief that he is an alien, a higher being, and he is here on Earth to ascend to another reality. He subscribes to QAnon, a group who believes a debunked and fictitious conspiracy claim that Satan-worshipping cannibalistic pedophiles are running a global child sex-trafficking ring and plotting against President Donald Trump.

The crimes charged in the indictment involve active participation in an insurrection attempting to violently overthrow the United States Government. By Chansley’s own admissions to the FBI and news media, the insurrection is still in progress and he intends to continue participating.

Strong evidence, including Chansley’s own words and actions at the Capitol, supports that the intent of the Capitol rioters was to capture and assassinate elected officials in the United States Government. Chansley left a note on the Senate Chamber dais, where Vice President Mike Pence had been presiding over the session just minutes before, warning “it's only a matter of time, justice is coming.” When questioned as to the meaning of that statement, Chansley went on a lengthy diatribe describing current and past United States political leaders as infiltrators, specifically naming Vice President Mike Pence, former President Barack Obama, former Senator Hillary Clinton and U.S. President-elect Joe Biden as infiltrators involved in various types of wrongdoing. Although he stated his note was not a threat, the Government strongly disagrees.

Even used his hunger strike against him.

Even now, Chansley continues to demonstrate a refusal to conform despite personal hardship as a consequence. Chansley’s choice to refuse to eat because he is not provided an organic diet in custody is predictive of how he will behave if conditions of pre-trial supervision do not suit him. If released, numerous conditions will alter and affect his routine and set forth daily expectations by which he must confirm. Chansley will not comply.

His lawyer has been asking in public for Trump to pardon him. As I understand it, if Trump is convicted in the impeachment, he can't issue pardons related to the impeachment.

But also note that Trump can issue pardons in secret without making them public.

Dude turned himself in to maximize his Presidential pardon chances since he knows Trump is gone on 1/20/21. By saying the most outlandishly pro Trump stuff he hopes to use the media as his tool for panhandling for said pardon. I think the FBI is being cautious and not adding anything from Title 18 until Trump is out of the picture. I know at least sedition applies.

Congress was in session performing the lawful act of counting electoral votes and was stopped as a result of his (and many others) forceful interference.

Excerpts:

14. A review of open source photographs also revealed photographs of a person, who appears to be the same individual wielding the shield in the video referenced in the paragraph above, at a Make America Great Again (MAGA) rally, which occurred in Washington, D.C. on or about December 12, 2020. In one of those photographs, the individual who appears similar to the individual who broke the Capitol window with a shield was wearing a black short-sleeved t-shirt with yellow, consistent with the “Proud Boys” logo. In another picture from the MAGA rally, also available on open source, the individual was wearing a t-shirt with a logo consistent with the United States Marine Corps. Depicted standing next to this individual in the same photograph is another person wearing a helmet bearing what appears to be the logo for the “Proud Boys.”

15. Another video posted to social media shows someone who appears to be the same individual that broke the window of the Capitol with the shield, smoking a cigar inside the Capitol building. In the video, the individual states words to the effect of, “Victory smoke in the Capitol, boys. This is fucking awesome. I knew we could take this motherfucker over [if we] just tried hard enough.”

He wanted to kill Pelosi and Pence, and was planning to come back on the 20th to kill everyone he can.

17. W-1 stated that after the events at the Capitol as described above, he or she spoke to an individual he or she knows as “Spaz,” along with other individuals. W-1 stated that during that conversation, “Spaz” bragged about breaking the windows to the Capitol and entering the building. In a subsequent interview W-1 clarified that “Spaz” said that he used a Capitol Police shield to break the window. W-1 said that “Spaz” can be seen on the cover of many newspapers and recognizes him from those photographs. W-1 stated that other members of the group talked about things they had done during the day, and they said that anyone they got their hands on they would have killed, including Nancy Pelosi. W-1 further stated that members of this group, which included “Spaz,” said that they would have killed [Vice President] Mike Pence if given the chance. According to W-1, the group said it would be returning on the “20th,” which your affiant takes to mean the Presidential Inauguration scheduled for January 20, 2021, and that they plan to kill every single “m-fer” they can.1 W-1 stated the men said they all had firearms or access to firearms.

21. On January 9, 2021, FBI located a publicly available Telegram account username @KINGbehavior. The profile listed a display name of Spazzo 2nd°. The Bio stated: “Marine vet / boxer / patriot/ Proud Boy 2nd°.”

A man from Kentucky told the FBI that he and his cousin began marching toward the U.S. Capitol on Jan. 6 because “President Trump said to do so.” Chanting “Stop the steal,” the two men tramped through the building and snapped a photo of themselves with their middle fingers raised, according to court documents.

A video clip of another group of rioters mobbing the steps of the Capitol caught one man screaming at a police officer: “We were invited here! We were invited by the president of the United States!”

A retired firefighter from Pennsylvania who has been charged with throwing a fire extinguisher at police officers felt he was “instructed” to go to the Capitol by the president, a tipster told the FBI, according to court documents.
Several others made that claim, and some of them are trying to use it as a defense.

A federal judge in Washington on Friday night halted a plan to release and put on house arrest the Arkansas man photographed sitting at a desk in House Speaker Nancy Pelosi’s office during last week’s riot at the U.S. Capitol.

Richard Barnett will instead be brought to Washington, D.C., immediately for proceedings in his case, Chief U.S. District Judge Beryl Howell ordered Friday night, staying a decision by another judge to confine Barnett to his home in Gravette, Arkansas, until his trial.


Far-right personality 'Baked Alaska' arrested in riot probe

FBI Special Agent Nicole Miller said in an affidavit filed in the case that Gionet streamed live for about 27 minutes from inside the Capitol and could be heard encouraging other protesters not to leave, cursing and saying “I’m staying,” “1776 baby,” and “I won’t leave guys, don’t worry.”

She wrote that Gionet entered various offices and when told by law enforcement officers to move, identified himself as a member of the media. Miller wrote that Gionet then asked officers where to go before cursing a law officer while alleging the officer shoved him, then leaving the building.

Gionet also posted video that showed Trump supporters in “Make America Great Again” and “God Bless Trump” hats milling around inside the Capitol and taking selfies with officers who calmly asked them to leave the premises. The Trump supporters talked among themselves, laughed, and told the officers and each other, “This is only the beginning.”

More than 125 people have been arrested so far on charges related to the violent insurrection led by supporters of President Donald Trump at the U.S. Capitol, where a Capitol police officer and four others were killed.

Charges from the Jan. 6 riot range from curfew violations to serious federal felonies related to theft and weapons possession.
They left behind a lot of evidence of their misdeeds, so a lot more of them may eventually be arrested.

A bartender, Watkins recently told the Ohio Capital Journal that she formed the “Ohio State Regular Militia” in 2019 — a unit of the Oath Keepers, the FBI said — and that the group has appeared at a dozen protests to “protect people.”
So some right-wing militias were also involved. Not just street fighters like the Proud Boys.

In the days following the January 6, 2021, events, a witness (“W1”) made several phone calls into the FBI’s telephone tip line related to the U.S. Capitol attacks. I have reviewed documentation of several of those calls. In them, the caller stated that he/she was the former romantic partner of RILEY JUNE WILLIAMS (“WILLIAMS”), that he/she saw WILLIAMS depicted in video footage taken on January 6, 2021, from inside the U.S. Capitol Building.

Russia Russia Russia.

The ex said she wanted to sell a Pelosi office laptop to "a friend in Russia." Unclear whether there was anything of such value on it.

W1 stated that WILLIAMS can be seen directing crowds inside the U.S. Capitol Building up a staircase. The caller specified the uniform resource locator (“url”) for a YouTube video that he/she was describing as url: https://youtube.com/watch?v=jJiSmVktty4&feature=youtu.be. W1 also claimed to have spoken to friends of WILLIAMS, who showed W1 a video of WILLIAMS taking a laptop computer or hard drive from Speaker Pelosi’s office. W1 stated that WILLIAMS intended to send the computer device to a friend in Russia, who then planned to sell the device to SVR, Russia’s foreign intelligence service. According to W1, the transfer of the computer device to Russia fell through for unknown reasons and WILLIAMS still has the computer device or destroyed it. This matter remains under investigation.

Her sweet father drove her to DC for a fun outing.

According to the Harrisburg officers, on or about January 16, 2021, officers called WILLIAMS’ father who resides in Camp Hill, PA. He stated that he drove to Washington, D.C., with WILLIAMS for the protests on January 6, 2021. He stated that his daughter and he did not stay together throughout the day and that WILLIAMS was meeting up with other individuals she knew at the protests. WILLIAMS later met up with her father outside of the U.S. Capitol Building, and they returned home to Harrisburg together

The statement references the above video and describes the contents, including how her mother recounts what I'd call her radicalization.

In this 2 ½ minute video, the reporter identifies “Riley Williams” as the person depicted in snippets of the prior ITV video described above. The reporter then interviewed a woman who identified herself as WILLIAMS’ mother and showed her some type of video footage. WILLIAMS’ mother then stated that she recognized her daughter inside the U.S. Capitol Building and that her daughter had taken a sudden interest in President Trump’s politics and “far right message boards.”

She has not been arrested yet, and is on the lam.

It appears that WILLIAMS has fled. According to local law enforcement officers in Harrisburg, WILLIAMS’ mother stated that that WILLIAMS packed a bag and left her home and told her mother she would be gone for a couple of weeks. WILLIAMS did not provide her mother any information about her intended destination. Sometime after January 6, 2021, WILLIAMS changed her telephone number and deleted what I believe were her social media accounts on Facebook, Instagram, Twitter, Reddit, Telegram, and Parler.

Run, Riley, run.

How many are simply flat-out stupid and don't have the wherewithal to understand what the difference between fascism and democracy is?
I'd be more interested to know how many don't enjoy participating in athletics, don't ride bicycles, are overweight, eat shitty diets, and I'd also be curious their level of education. Brains need physical exercise.

Seems like the crowd was rather mixed in inclusiveness. I recall seeing a "Blacks for Trump" sign. I also note that the young man in furs was Jewish while the mob included men wearing "Camp Auschwitz" and "6MWE" ("Six Million Wasn't Enough") T-shirts. There was also someone fired who was there -- and who claimed that it was safe for him because there weren't a lot of neo-Nazis there.

How many truly believe they are patriots upholding democracy, and are motivated by anger, genuinely believing The Big Lie ("Trump won in a landslide")?
How many just want to break things?
How many are trying to destroy America because they hold to fascist or other ideologies?
How many are simply flat-out stupid and don't have the wherewithal to understand what the difference between fascism and democracy is?
I'd be more interested to know how many don't enjoy participating in athletics, don't ride bicycles, are overweight, eat shitty diets, and I'd also be curious their level of education. Brains need physical exercise.

Why is their health or education of any relevance? :confused:

It takes effort, time and commitment to do these things. Leaves a lot less time to watch political soap operas and fly across country to riot for your savior.

Riley Williams has turned herself in. The DOJ site has an Amended Statement of Facts that says,

A complaint and arrest warrant were issued in the U.S. District Court for the District of Columbia on January 17, 2021. United States v. Riley June Williams, 21-mj-99.WILLIAMS, who was aware of the warrant and charges, surrendered to authorities and was arrested in Harrisburg, Pennsylvania, on January 18, 2021.

The Complaint was amended too. Amended Complaint

It added charges for embezzling US property and for obstruction an official proceeding.

The Amended Statement of Facts gave more details,

Her ex gave the FBI a video captured from a livestream showing the theft of the Pelosi office laptop,

On January 18, 2021, FBI agents obtained from W1 copies of several video clips that W1 stated had been recorded and livestreamed by WILLIAMS and subsequently copied or screen captured by a friend of WILLIAMS. I have reviewed several of the videos, which appear to depict events inside and outside the U.S. Capitol Building on January 6, 2021. In one 4- second video, the person holding the cell phone camera is standing, angling the camera down toward a wooden desk with an “HP” laptop. A female voice that I believe to be WILLIAMS’ based on my review of the ITV YouTube video described above can be heard saying, “Dude, put on gloves.” Next, what appears to be a man’s arm then reaches toward the laptop, with a black glove covering his hand, and begins to lift the laptop off the table. There is text across the video clip that reads: “they got the laptop.” Given how loud Williams’ voice is, it seems likely that she was the one holding the cell phone camera. A screenshot of the video clip is below.

They confirmed her presence there with CCTV. And they have Discord posts by a Riley admitting to it,

I have obtained and reviewed CCTV video footage taken outside of Speaker Pelosi’s office and confirmed that WILLIAMS can be seen entering and exiting Speaker Pelosi’s office. Emanuel Jackson is on surveillance video using a baseball bat against a police line. There are screencaps in the Statement of Facts. He has been charged and is in custody. Derec will be happy to know he is a young black man.

He is charged with: Assaulting an Officer of the United States with a deadly or dangerous weapon, Obstruction of an Official Proceeding; Knowingly Entering or Remaining in any Restricted Building or Grounds Without Lawful Authority; Violent Entry and Disorderly Conduct on Capitol Grounds.

From the Statement,

At 4:50 p.m., the violent and aggressive crowd continued to confront law enforcement at the West Terrace entrance. The crowd was armed with various weapons and multiple individuals are observed assaulting law enforcement in the entranceway. The defendant is clearly observed in surveillance video of this entrance, wearing the same clothing described above and observed in earlier footage, and armed with a metal baseball bat. The defendant is observed repeatedly striking a group of both U.S. Capitol and Metropolitan Police Department uniformed officers with the baseball bat. U.S. Capitol Police officers are designated as officers of the United States under Title 18 U.S.C. 1114. The officers are shielding themselves with the Plexiglas shields for protection.

Unclear from that whether he injured anyone or just hit the shields.

They found public video of him, but I haven't found it.

During the investigation, law enforcement discovered an open source media video of the incident from January 6, 2021. On the video, photographs of which are included below, the defendant is observed holding and swinging the bat, which matches the shape and appearance of the bat in the surveillance video from the Capitol Building.

He turned himself in and basically confessed. :facepalm:

On January 18, 2021, the defendant voluntarily entered the First District Metropolitan Police Department station. Your affiant explained the defendant’s constitutional rights to him and the defendant knowingly waived his rights by signing a Miranda rights card. The defendant admitted to taking part in the violent protest, identified himself in video and photographs shown to him by law enforcement of himself, and confessed to perpetrating the violent conduct described above.

They are starting to redact the FBI agents' names on these documents, making me wonder if someone's been threatened or just precautionary.

A local news report on Jackson, he's from Maryland.

That story has video of him saying,

Asked why he was there, Jackson replied, “Fighting for America. We’ve been taken over by globalists, by the Chinese. Fighting for America. I’m not here for Trump. I’m here for America.”

He then said he didn’t vote because “I thought my vote didn’t count, but I learned a lesson, and I will vote next in the midterms and in other elections.”

Which would mean he still voted for Trump then, and believes the same things.
