FOSTA isn't nearly the issue that the insanity of what DMCA takedowns have become.

1) DMCA notices are filed under penalty of perjury--yet absolutely nothing is done about obviously false ones.

2) DMCA notices are filed about things where they clearly don't have copyright. Works long out of copyright, works that are explicitly in the public domain (the national anthem of Kenya was recently hit), works where the author has a proper license for the material he used, and sometimes purely for extortion.
