From what I can tell, it appears the argument that the governor of Texas and Derec are making is that is legal to kill any perceived leftist who is either carrying a weapon or scaring you.

I can't address Derec's position, but the right wing approach here is to be myopic--looking only at the immediate situation it's legitimate self defense. Where it fails (and what caused the jury to convict) is self defense has a clean hands requirement. By driving into the crowd he provoked a defensive reaction--he does not get to defend himself against that reaction.
