Ray McDonald to sue for defamation

 
 
 
According to the article, he has not been charged so there is nothing to drop.
 
Watch Derec's standard for evidence vanish when he suggests that the burden of proof for a defamation case shouldn't be as stringent as his threshold for proving rape.

Burden of proof for a false rape prosecution (as unlikely as it is unfortunately) should be the same as burden of proof for the rape prosecution.
Burden of proof for the defamation suit should be the same as that for her suing him over this alleged "rape" (which was likely the endgame for the allegation anyway given that he is a football player).
That's the difference between criminal and civil (tort) cases.

If the video really shows consensual sex I hope he wins the suit and gets to garnish her wages for a long, long time...

Apparently he can't sign with another team while under threat of indictment. While they haven't charged him they haven't dropped the case either. If the video really shows what they say it shows, it's unconscionable to drag this thing out.

If he is innocent and is being falsely accused of rape by this woman what different outcome of his lawsuit do you hope for?

I was kind of pointing out how you typically always fall to the side of she is a lying scumbag. You say we should wait to see the evidence, but always always always are on about the guys innocence.

Reportedly there is a video that show them having consensual sex. Also I prefaced my statement with "if the video really shows consensual sex". What part of that do you not understand? If the video shows consensual sex then he is innocent, she is a lying scumbag and he should win the lawsuit (and she also should be criminally charged). Which part of that do you disagree with?

And if that alleged video does not exist or if it does not show them having consensual sex, would you agree MacDonald should be fined for wasting the court's and the woman's time and resources?

Sure, but I have yet to see you or Jimmy (or Playball who started this thread) say that she should be punished if she falsely accused him.

If she knowingly made a false accusation, then yes. If she made a mistake, then no.

The prosecutor should only bring the case forward if he can prove it without a reasonable doubt.

Well, it's nice to see attention to due process is back for this thread anyway.

Its appeal has been getting very selective around here.
