"Due process." Maybe if the inanimate objects didn't commit any crimes they wouldn't be seized.

well, wouldn't citizens United be appli cable here: if money is speech, and money can commit a crime, isn't that an impediment of free speech?

That's a good point. Civil forfeiture laws are a 1st amendment infringment.

Yeah, this ball seemed to start rolling downhill faster, with the passage of RICO back in 1970, and as more and more states copied the construct...

Somehow we need to get the money out of policing. When the police write a ticket I'd like to see the money go to pool for highway improvement or something. If they seize money it shouldn't go to the police department. Whenever I see a $40K police SUV with the words: "To protect and serve" I just shake my head. Get them out of their cars. Put them on bicycles. Take away their guns in some circumstances.
