Scalia was questioning the attorney for the University of Texas, which is defending its use of race as a factor in admissions in the case before the court.

"There are those who contend that it does not benefit African-Americans to get them into the University of Texas where they do not do well, as opposed to having them go to a less-advanced school, a less -- a slower-track school where they do well," Scalia said, according to the transcript. "One of the briefs pointed out that most of the black scientists in this country don't come from schools like the University of Texas."

The attorney, Gregory G. Garre, tried to interject, but Scalia continued.

"They come from lesser schools where they do not feel that they're being pushed ahead in classes that are too fast for them," Scalia said. "I'm just not impressed by the fact that the University of Texas may have fewer. Maybe it ought to have fewer. And maybe some -- you know, when you take more, the number of blacks, really competent blacks, admitted to lesser schools, turns out to be less."

Have fun folks.

Geez. Why not just call them negroes if that's the stance you're going to take?

Also, ha ha! That guy's on your Supreme Court and you can't fire him.

How do you get that? Do you disagree that there are schools of lower quality than the U of Texas or that less qualified applicants tend to go to them?

Yeah... Scalia. The Justice who thought gay sex should still be a criminal offense.

He can be impeached. He won't, but it is possible.

How did you get that from what I said? Let's talk past each other a bit more.

I'm not sure what you objection is. Can you be specific?

When you are sitting for a case about affirmative action helping less qualified black people get into the University of Texas as opposed to some lesser school, are you supposed to pretend the case is about something else?

If so, what?

Top of the Texas heap might still be a low bar.

You've never stumbled upon the campus of the College of Arts and Sciences at Chickasha. After meeting a grad who didn't know what an exponent or parentheses meant in a math equation (and who asked me to show her how to do a simple average of two numbers) I KNOW what a low bar is.

Top of the Texas heap might still be a low bar.

US News and World Report Ranks it at 52 overall among 200 ranked national universities.

Its business school is ranked 7th in the nation. Its ranked first in accounting and seventh in Finance. In MIS it is 5th, in quantitative analysis it is ranked 9th. It is 4th in Chemical Engineering and 8th in Computer Engineering. It is 16th among all public colleges and its law school ranks 15th.

U of T equals Pepperdine and out ranks George Washington, Purdue, U of Mass, Clemson, Michigan State, U of Colorado several UC campuses, some SUNY campuses, and 150 other nationally ranked universities.

"What a dump", eh?

Scalia does have a point - it is Texas after all.

He's got a point in general. It's not a matter of sending all blacks to slower schools, it's a matter of sending students to schools that match their ability. The result is more of them will graduate. Graduating from State U is a lot better than flunking out of Elite U.

I'm sure the bright progressive lights on the court will let the University of Texas know the progressive position is "sorry, did you not know your school sucks?"

Then I'm sure it is self evident among progressives that if UT sucks it should bend its admission policies to let in more minorities. That easily follows from progressive Logic.

Education as a whole is a joke.

What passes for education in this country?

Giving people some boring shit to memorize and then asking for immediate regurgitation.

That is the lowest form of education and most forget 99% of what they supposedly learned in short time.

Perhaps black students don't have as much motivation for this stupid game as others. Perhaps they are really the intelligent ones.
