Hitting Fake Nazis with a Handbag should NOT be a Hate Crime

Okay, so if someone is a Nazi faker or you think they are a Nazi but they are not really a Nazi and so you hit them over the head with your handbag, it might or might not be a crime, but it should not be a HATE crime.

I’m reluctant to think there should even be such a thing as a hate crime on the books because there’s too much hysteria-based abuse to conflate anger-driven crimes as being hate based. I have no intentions whatsoever of committing a hate crime, but if I’m pissed off and commit a crime and find myself spewing vulgar group targeted language towards whatever group the victim belongs (just to piss them off), the penalty can all of a sudden be substantially escalated beyond whatever penalty is usually present for the crime without the factor of hate. The fact there is a mismatch behind my actual reasoning for committing the crime and the misguided and purported beliefs of others, I stand to suffer unreasonably escalated consequences.

Some posters around here when discussing ethics refer to moral intuitions as some kind of basis for analogies and fundamentals. I really wonder about moral intuitions in this specific instance because it feels right for an old lady with a handbag to hit a neo-Nazi over the head. I am not going to extend that moral intuition to punching neo-Nazis or to universally everyone having a go at the neo-Nazi, just one old lady hitting him over the head.
