The fetus has reflexes before the 7th month, that's not the same as being conscious. Reflexes can exist without having a brain at all.

There is conjecture and beginnings of experimental evidence that mind is an emergent property of a large enough set of neurons with enough connectivity. Simple brains can react to stimuli (even unicellular organisms react to environmental stimulus) and exhibit self awareness in the most basic sense. I make an effort to distinguish self awareness from consciousness here, but that's a topic in itself.

Larger and more interconnected neural meshes exhibit more and more complex behaviours... we humans being the most complex we know of. Our near cousins, the higher apes, are close, and I think they are conscious, but not as conscious as we are.

You have to remember that LIRC et al don't give a flying fuck about what happens once the fetus is born, even if it's to a damaged or disabled, painful life. And gawd existed, she is a crap designer for letting the placental barrier be permeable to alcohol.
