Donald Trump’s latest executive order could give him the power to mount a scorched-earth campaign which would cripple a future Biden administration.

Cannot just play the Reverse card on an EO. After it's issued, it sparks more paperwork, enacting the policy, enumerating the steps and so on.

But i think it would allow Biden to just fire everyone hired after 20 October, THEN enact legislation to reverse the tantrum.

Another provision orders agencies to take steps to prohibit removing “Schedule F” appointees from their jobs on the grounds of “political affiliation,” which could potentially prevent a future administration from firing unqualified appointees because of their association with President Trump.

But should he lose his re-election bid in just under two weeks, New Jersey Chief Innovation Officer Beth Noveck — an NYU professor who served as the first US Deputy Chief Technology Officer — said the order appears to be designed to enable him to exact revenge on Fauci and any other federal officials he blames for his loss.

“It's the twin danger of both firing Fauci and replacing him with Eric Trump's wedding planner permanently,” said Noveck. She compared the order to the fictional “infinity gauntlet” weapon made famous by the Avengers films, citing the way it could enable Trump to get rid of countless tenured federal workers with the stroke of a pen.

“There's definitely a ‘snap your fingers and get rid of half the civil service’ quality to this,” she added, noting that the order lays out vague and subjective criteria for determining whether an employee reclassified under “Schedule F” can be fired for “poor performance”.

Noveck added that such vagueness made it possible that Trump could use the “preliminary” list he has ordered OPM to prepare to cripple a Biden administration’s Covid plans by targeting Fauci and other scientists or the administration as a whole by removing large numbers of experienced workers.

Though I don't now why if Trump can do this with an executive order why Biden couldn't just undo it with an executive order.

Trump has issued so many horrible executive orders that I hope that assuming Biden wins can just undo them.

This is the American future, lurching from side to side like we are coursing down a slalom. Abrupt reversals after 4 or 8 years. Allies who can't tell who the hell we are as a nation. No effective way to deal with the big stuff: climate change, health care, gun violence, the national debt. I don't see an exit strategy, because there is no such thing as a charismatic leader who can cross party lines anymore for consensus, and because party identity is not just intense, it's often radicalized.

Ponder if this can get held up in court and prevent this absurd action. This is effectively trying to upend democracy.
 
If he does this and loses the election, Biden should go scorched earth right back and order the Justice Dept to prosecute him for every single thing they can dream up. All his minions too. And they’re all flight risks, so Gitmo here they come.

And I’d make sure his team got the message that if he does this, he’d better win.
 
Civil service laws were written by congress and signed by the president long ago. I really wonder if Trump actually has the authority to do this.

Hopefully yes. However, we're not sure that Biden will win. I'm thinking that it's 50-50.

President Donald Trump has fired his biggest broadside yet this week against a federal bureaucracy he has moved to remake with an executive order that would remove job security from an estimated tens of thousands of civil servants.

The directive, issued late Wednesday, strips long-held civil service protections from employees whose work involves policymaking, allowing them to be dismissed with little cause or recourse, much like the political appointees who come and go with each administration.

Federal scientists, attorneys, regulators, public health experts and many others in senior roles would lose rights to due process and in some cases, union representation, at agencies across the government. The White House declined to say how many jobs would be swept into a class of employees with fewer civil service rights, but civil service experts and union leaders estimated anywhere from tens of thousands to hundreds of thousands in a workforce of 2.1 million.

I'd actually argue it's more important that all the Trump enablers get prosecuted before Trump. Trump himself is pretty powerless without the people behind the curtain propping him up. And to be fair, all the reprehensible shit he's done has merely been stuff conservatives have been dreaming about for years. If Biden wins, it's going to be more important to put processes in place to stop the next Trump, because if it happened once, it can happen twice.

Also, I'm not sure tit for tat will produce the outcome you expect.

I don't see anything that prevents Biden from reversing it. Having said that, it was not very nice of Obama to screw Russia after Hillary's loss in 2016.
