The probability of that occurring is greatly reduced when the victim cannot talk.

It depends on several items. If Apperson is telling the truth then it would have been better if Z was dead. If Apperson is lying, it's better that Z is still alive.

When the cops arrived the guns in Z's truck were stowed. If Z is dead and Apperson is lying then there is no chance that Apperson gets off with Z brandishing a gun. But being alive there is still an argument that he pulled one out, showed it, and then put it back. And Z's testimony on the stand isn't helping his case, his cavalier attitude and beliefs could easily split the jury helping Apperson

Just to be clear, I'm not advocating for anyone to punch the spouse abusing racist murderer Zimmerman.

I'm just saying that I laughed when I found out he did get punched in the face.

Could Apperson convince a jury that he recognized Z and THOUGHT he saw a gun, and responded in self defense according to the facts he apprehended at that time?

He can try, but it's believable if Zimmerman had been killed and and the gun was on the floor or seat with his fingerprints on it.

I believe Zimmerman got off because his victim was not around to testify. i believe Apperson's legal troubles would end up less severe if Zimmerman could not testify. The fact that Apperson is not an asswipe like Zimmerman is what possibly saved Zimmerman's life. An irony that I am sure is completely lost on Zimmerman and his adulators.

That's an excellent point. What if Zimmerman had died and Martin was the only one telling the story of what happened.

His story would have been "There a creepy guy following me", confirmed by his conversation with Jeantel. Zimmerman was following him, confirmed by Z's conversation with police dispatch. Z attacked M, confirmed by Jeantel's description what she heard over the phone. No conflicting testimony from Zimmerman. No defence attorney bringing in a hunk of concrete to show a weapon. If the jury and system isn't biased by racial prejudice (and I'm not saying it is), Martin would have walked.

If cops show up to a fight with one person calling the police before the fight and only one person bloodied, 9 times out of 10 the person without the wounds would be charged with assault. They wouldn't have too much problem with that charge.

I've pointed it out several times in the Z vs. M thread. Jeantel's testimony of hearing Trayvon yelling "Get off me!" several times when the confrontation starts. Then hearing the phone being knocked from M's hand.

No. The get off was after they had started wrestling on the ground. It was after she heard the grass blowing sounds. She also said that on one of the talk shows she didn't know how it started but believed Martin threw the first punch and was opening a can of whoop ass on him.
