1. Of course it is not a capital crime. Something being a capital crime is not a necessary condition for a police shooting to be justified.
2. He wasn't shot merely for having a suspended driver's licence. Not even for trying to bribe the officer with a bottle of gin. The shooting only occurred when DuBose prevented the officer from opening the door and started to drive off. Details are blurry of course because of the shaking of the body cam (which means the officer's body was moving around vigorously immediately before the shooting)
Still doesn't mean it was justified of course, but neither is the claim true that DuBose "did nothing wrong".
