I'm pretty dam sure that a judge would laugh at that kind of defense. " She said she was 18, your Honor".
 
I think age misrepresentation should definitely be a valid defense against these kinds of charges, yes.
I also think 16 years is a better cutoff for age of consent than 18. 18 (or above) is actually pretty rare in the civilized world.

Yes. In an interview with Tucker he literally described her as "a 17 year old woman".

Greenberg, his friend who allegedly provided Gatez the 17 year old, pled guilty to trafficking a minor for sex:

according to his plea agreement, he acknowledges that he "acted in reckless disregard of the fact that the Minor was less than 18 years old when he engaged in commercial sex acts" and had a "reasonable opportunity to observe" that she was underage.

Seems the same could be said of Gatez, acting in reckless disregard to the possibility that she was under 18, even if he didn't know for certain.

I think grown ass men should walk away if there's even a whiff of possibility of a potential sex partner being underage. It's not like he had no choice. It's not like he had no ethical responsibility.

The kind of men who say "she said she was 18" have no moral compass or functional sense of empathy, and don't waste a second worrying about the balance of power there. The Matt Gaetzes of the world are well aware of their power and have no intention of being mindful of it beyond keeping up appearances. We see them.

That can be presented to the judge before the sentencing and after the conviction. It might help, but the judge has heard that one before. Why not try, "The Devil made me do it." If a person has sex with another person who is legally incapable of giving consent, it's a crime, as defined by the applicable statute.

This crime falls into the category of "exploiting the helpless" and blaming it on her only compounds the sin.

Thanks to our post anything makes sense world, the GOP can take the likely accurate testimony against Gaetz indicating he fucks people much younger than him (sometimes pays them) at drug fueled parties as baseless attacks on him. IE using the truth to deflect the truth. I think he might get confirmed now with the information coming out against him.

An unidentified person appears to have accessed documents shared among lawyers in a lawsuit that concerns allegations against former congressman Matt Gaetz (R-Florida), according to a person who received an email notifying them of the breach. The person spoke on the condition of anonymity to discuss a sensitive matter.



The file contains unredacted sworn testimony from a woman who said Gaetz paid her for sex when she was 17, along with other depositions from witnesses involved in the case, said a person who was notified of the hack, which was first reported by the New York Times. Gaetz has denied having sex with anyone underage or paying for sex.

A person named “Altam Beezley” downloaded the exhibits, according to a confirmation email received from a shared file database.

“I have not been able to identify the person who downloaded the files, but I have contacted the email address provided, asking the person to identify him or herself, instructing that their access is not authorized, and telling them that they should destroy the materials they downloaded,” wrote the lawyer who discovered the breach. “My email was returned because the email address was not found.”

My guess is that fucking people much younger than himself at drug fueled parties is his qualification.
 
Why not. Last month an AARP-plus aged lady in our town went around wearing a "Yes I'm Voting for the Convicted Felon" tee. And her side won. I want to see her in a "Yes I Want the Coked-Up Sex Predator for AG" tee, stat.
That's MAGA. It's only crazy if you're all alone.
