Oh, I'm sure they'll figure out some way to deal with the mentally challenged that doesn't involve bullshit arrests or police brutality. The article did mention they can "call a specialist trained in crisis intervention or a supervisor to help determine how to proceed". And I'm sure they're not all that stupid themselves.

I wasn't even thinking of the mentally challenged, but someone willfully refusing to "understand".

When I revived this thread I reposted part of the discussion about the relevant statutes. This new policy doesn't change the law, it's designed to promote compliance with it, both by the police and the public.

The police can arrest a trespasser if a notice of trespass has been issued and the person who received it continued to trespass. That was the case then and it's the case now. Here's the tricky part: the two guys in Starbucks hadn't been given a notice of trespass therefore the arrests were unlawful. No amount of retrofitting can change that. The new policy is designed to address that glaring lack of probable cause so that in the future, arrests for trespassing will be lawful police action, not violations of civil rights.
