The Department of Justice has secretly asked Congress for the ability to detain arrested people “indefinitely” in addition to other powers that one expert called “terrifying”

The Trump Department of Justice has asked Congress to craft legislation allowing chief judges to indefinitely hold people without trial and suspend other constitutionally-protected rights during coronavirus and other emergencies, according to a report by Politico’s Betsy Woodruff Swan.

While the asks from the Department of Justice will likely not come to fruition with a Democratically-controlled House of Representatives, they demonstrate how much this White House has a frightening disregard for rights enumerated in the Constitution.

The DOJ has requested Congress allow any chief judge of a district court to pause court proceedings “whenever the district court is fully or partially closed by virtue of any natural disaster, civil disobedience, or other emergency situation,” according to draft language obtained by Politico. This would be applicable to “any statutes or rules of procedure otherwise affecting pre-arrest, post-arrest, pre-trial, trial, and post-trial procedures in criminal and juvenile proceedings and all civil processes and proceedings.” They justify this by saying currently judges can pause judicial proceedings in an emergency but that new legislation would allow them to apply it “in a consistent manner.”

And so it begins...

COVID-19 as a Reichstag Fire

DOJ seeks new emergency powers amid coronavirus pandemic - POLITICO - "One of the requests to Congress would allow the department to petition a judge to indefinitely detain someone during an emergency."
The Justice Department has quietly asked Congress for the ability to ask chief judges to detain people indefinitely without trial during emergencies — part of a push for new powers that comes as the coronavirus spreads through the United States.

Documents reviewed by POLITICO detail the department’s requests to lawmakers on a host of topics, including the statute of limitations, asylum and the way court hearings are conducted. POLITICO also reviewed and previously reported on documents seeking the authority to extend deadlines on merger reviews and prosecutions.

Seems like the  Reichstag fire and the  Patriot Act all over again.

What took them so long? Republicans must really be in disarray if it's taken them this long to abuse a national emergency to give their party and their king even more authoritarian powers.

The trouble is the election in November. The GOP has shown us they are very much willing to give it the middle finger and let Congress vote in a contested election.

That is the biggest threat at the moment.

That and Ohio has given the Chief Supreme Court Justice the power to dictate changes in law.

So they should simply not arrest anyone? The normal protections assume a working court system, with courts shutting down what are they supposed to do??

What makes me more suspicious is when reporters use terms like “quietly” to imply it was done clandestinely.

What alarms me, is that the Trump regime already has the power to hasten or delay the peak level of the pandemic in the US, and I fear they will make every effort to make it coincide with the election in November, at the cost of millions if not tens of millions of lives.
How?

Indeed. These bats have been flying around in my head for a month or more.

Read that? I'm afraid to. :worried: I'll go enjoy my evening and read it and lp's link in the morning.
I need some happy.

Like the GOP has the ability to influence this pandemic. They can take advantage of it, but they can’t manipulate the disease itself.

Yes, they can.
Read the article, then tell me about it.
The duration of increasing numbers of infected (the length of the uphill side of "the curve") can be influenced through both resource manipulation and by the timing of suppression measures. Those effects can be quantified - check it out.
I suspect that the administration's laggardly federal response right now is partly ineptitude and partly the dim realization that this might be their savior from having to face an election this fall, if they can string it out long enough.

The people who hate this would be the first ones complaining if someone murdered their family member and the cop said, "No court system right now. He's free to go."

Seriously - it holds out some hope, and I found it slightly settling to have a much better grasp of the variables in play here, which ones are really important, and how to anticipate outcomes for x,y, z actions or inactions. It's a good thing...

Lacking any real world evidence to support his side, Halfie ONCE AGAIN invokes AU fanfic in place of anything resembling an argument.

It's perfectly rational. You're just stalling because you don't have an answer.

People who hate that understand why we have the Constitution we have and why it's important to not override its fundamentals to give power to one branch of government. What you describe there is a non-functional judicial system, and we absolutely do want a functioning judicial system. We don't want murderers getting off scot free and we don't want people unconstitutionally arrested and detained indefinitely. Why is this rocket science?

So they should simply not arrest anyone? The normal protections assume a working court system, with courts shutting down what are they supposed to do??
So can we conclude you are fine with arresting and holding them indefinitely (which included alleged rapists)?
