The felony robbery had been committed already. The murder didn't happen during that crime, it happened while he was running away. Is fleeing the scene of the crime a felony? Maybe. But if you're defending the shooter, good luck with the "he made me do it" defense. I wonder if, since the robber was NOT on the shooter's property at the time of the shooting, perhaps the very act of going all cowboy in public is a felony? Prolly not in TX, but maybe...
If so, the felony murder charge certainly should accrue to the shooter, dontya think?
