To prove your "felony murder" charge of course. Felony murder doesn't require the intent to kill, but it does require proving the intent to do a felonious act which causes a victim's death.
The felony robbery had been committed already. The murder didn't happen during that crime, it happened while he was running away. Is fleeing the scene of the crime a felony? Maybe. But if you're defending the shooter, good luck with the "he made me do it" defense. I wonder if, since the robber was NOT on the shooter's property at the time of the shooting, perhaps the very act of going all cowboy in public is a felony? Prolly not in TX, but maybe...
If so, the felony murder charge certainly should accrue to the shooter, dontya think?

If someone broke into your home abs was hurting or attempting to hurt you or another person: of course you have the right to fend yourself or another person. But for that $50 lying in your dresser? I can’t imagine valuing anyone’s life less that a few dollars.

If anyone breaks into my home they are getting the maximum response because my family is in here. I don't give a damn what they came to get.

This is the point of castle doctrine--the defender isn't expected to figure out the intruder's objectives.

Shooting at fleeing criminals, though--there are times when it's not apparent whether someone is actually fleeing or moving away for some sort of tactical advantage (to get to cover, hostages etc.) I would give the benefit of the doubt to the defender in such a case, but Texas is nuts.

I have. It was a kid looking for one of my kids who was spending the night elsewhere. The dogs didn’t raise a ruckus because they knew her. I gave her a stern talking to as I escorted her to the door and silently thanked my lucky stars I had not grabbed the baseball bat as I left my bedroom.

That's cool. Glad it turned out that way, but how did you go about finding out who it was? Did you say who is it and she answered? Because when I yell "ay yo who TF is dat?!" and I don't like the answer, it's BANG.

That's cool. Glad it turned out that way, but how did you go about finding out who it was? Did you say who is it and she answered? Because when I yell "ay yo who TF is dat?!" and I don't like the answer, it's BANG.
I saw her—almost bumped into her, in fact. Asked her what she was doing there, told her the kid she was looking for was spending the night at a friends, a little bit of what for walked her to the door. And when kid got home, I gave them a bit of what for, having friends sneak into the house at night…

The thing is, I know of a lot of cases where someone killed someone’s else, accidentally. Not realizing the victim was there, shot gone wild, some old man convinced he was shooting a deer ( from his front porch) when he actually shot a horse out from under a girl who was riding it. People do stupid stupid stuff all the time and it gets real deadly when a loaded firearm is involved. Kids —toddlers! accidentally shooting a parent or sibling, a grandparent killing his teenaged grandchild who was sneaking in the patio door at night.

I have no problem beating the living shit out of someone who was harming/trying to harm someone. But generally speaking, it’s pretty hard to throw a punch and hit a child in a pick up by accident. Usually you get an up close look at your target.

Now, I don’t live in a particularly crime ridden place.

I’ve also been thinking about what I’m about to type abs about others who’ve typed the same words in a different context:

I choose not to live in fear.

I remember a guy shot his own daughter to death as she came home late at night.

Now, I don’t live in a particularly crime ridden place.
I'm in the warzone right now. It's much much nicer than where I was raised.

Unfortunately life has taught me that the things that do get the ones you love are not stopped by baseball bats, we’ll placed punches or bullets.

And I learned a very valuable lesson the time my uncle almost got shot. He, my dad and my grandfather were some really tough guys—the kind who generally stopped someone with a look. I learned lessons from all 3 sets of close rekatuves who survived armed home invasions, one of which also involved a kidnapping and a hostage situation and multiple SWAT teams—and no injuries to anyone.

You have no idea but my wife has been pushing for us to go where there is snow almost all year around. 15 hundred miles north sounds like I'd be set for several Valentine's Days.
