Judge lifts parts of Trump gag order ahead of sentencing in New York criminal case

The judge in Donald Trump’s hush money trial has lifted portions of the gag order restricting what the former president can say about witnesses in the trial, such as Michael Cohen and Stormy Daniels, two days before Trump will square off against President Joe Biden at the CNN Presidential Debate.

Trump, however, cannot discuss any prosecutor, court staffer or their family members, according to a court order on Tuesday from Judge Juan Merchan that rolls back parts of the gag order imposed before the trial began. That aspect of the gag order remains in effect at least until his sentencing, which is set for July 11.

The new order Tuesday also lifts the bar on public statements about jurors but notes disclosure of any personally identifying information of any juror is still prohibited.

#SCOTUS for the first time on recognized that ex-presidents have immunity from prosecution for certain actions taken in office, as it threw out a judicial decision rejecting Donald Trump's bid to shield himself from criminal charges involving his efforts to undo his 2020 election loss.

The court ruled that former presidents are shielded from prosecution for actions they take within their constitutional authority, as opposed to a private capacity. The ruling marked the first time since the nation's 18th century founding that the Court has declared that former presidents may be shielded from criminal charges in any instance.

Trump is the Republican candidate challenging Democratic President Joe Biden in the Nov. 5 U.S. election in a rematch from four years ago. However it rules, the court's slow handling of the blockbuster case already has helped Trump by making it unlikely that any trial on these charges brought by Special Counsel Jack Smith could be completed before the election.

Trump had argued that he is immune from prosecution because he was serving as president when he took the actions that led to the charges. Smith has opposed presidential immunity from prosecution based on the principle that no one is above the law.

The court found Trump was absolutely immune for conversations with Justice Department officials. Trump is also "presumptively immune" regarding his interactions with Pence, it decided, but returned that and the two other categories to lower courts to determine whether Trump has immunity.

The ruling marked the first time since the nation's 18th century founding that the Supreme Court has declared that former presidents may be shielded from criminal charges in any instance. The court's conservative majority includes three justices Trump appointed.
