Starting a new thread for the judicial proceedings against the insurrectionists.

First up is Jacob Anthony Chansley aka Jacob Angeli aka QAnon Shaman.

He is being tried in DC, and this is the Indictment.

That just lists the basics of the 6 charges: civil disorder, obstruction of an official proceeding, entry and remaining in a restricted building, disorderly and disruptive conduct in a restricted building, violent entry and disorderly conduct in a Capitol building, parading, demonstrating, or picketing in a Capitol building.

But the US attorney yesterday filed a brief in support of detaining Angeli which has more detail.

GOVERNMENT’S BRIEF IN SUPPORT OF DETENTION

It is quite a read, most of the 17 pages is arguing why he's a flight risk, but it also goes into details of what he did at the Capitol and how explicitly he admitted during that he was there to overthrow the government, and how he wanted to come back for the inauguration. Here are some excerpts. It starts out,

For the reasons set forth below, the Court should order Chansley to be detained pending trial. Chansley is an active participant in—and has made himself the most prominent symbol of—a violent insurrection that attempted to overthrow the United States Government on January 6, 2021. Chansley has expressed interest in returning to Washington, D.C. for President-Elect Biden’s inauguration and has the ability to do so if the Court releases him.

It says he was carrying a weapon, which makes the charges worse. His flagpole was a spear, the document includes photos within the text (nice how they can do that now).

Chansley approached Officer Robishaw and screamed, among other things, that this was their house, and that they were there to take the Capitol, and to get Congressional leaders. Chansley also used his bullhorn to communicate that they were there to take out several United States congressmen.

He even left a threatening note for Pence.

Officer Robishaw, alone with more than 25 rioters in the Senate Chamber, attempted to engage with Chansley and asked for his assistance to use the bullhorn to get the protestors out of the Chamber. Instead of doing so, Chansley ran up on the dais where Vice President Pence had been presiding just minutes before, and begin posing on the dais for other rioters to document and photograph, and wrote a note to Vice President Pence saying, “it's only a matter of time, justice is coming.”

He actually called the FBI to confess.

On January 7, 2021, Chansley called the Washington Field Office of the FBI and requested to speak with law enforcement. Chansley confessed that he was the man photographed at Vice President Pence’s chair on the Senate dais, face painted, carrying the spear and wearing a horned helmet. He said that he was able to get into the United States Senate in D.C. “by the grace of God.”

How he bragged to media about the attack.

“The fact that we had a bunch of our traitors in office hunker down, put on their gas masks and retreat into their underground bunker, I consider that a win,” Chansley said. Chansley stated that he drove to Washington, D.C. as a part of a group effort, with other “patriots” from Arizona, at the request of the President that all “patriots” come to D.C. on January 6, 2021.

He planned to go to the AZ Capitol next.

Twice, Chansley told the FBI that he had plans after the January 9 FBI interview to drive to the Arizona State Capitol. Corroborating his statement, Chansley had his horns, furry coyote tail headdress, face paint, tan pants, sixfoot-long spear, and his bullhorn inside the 2003 Hyundai that he parked at the FBI.

Some on why he is a flight risk.

Chansley also stated he has no mental health conditions, but publicly-available information and videos reveal a very different picture. Chansley has spoken openly about his belief that he is an alien, a higher being, and he is here on Earth to ascend to another reality. He subscribes to QAnon, a group who believes a debunked and fictitious conspiracy claim that Satan-worshipping cannibalistic pedophiles are running a global child sex-trafficking ring and plotting against President Donald Trump.

The crimes charged in the indictment involve active participation in an insurrection attempting to violently overthrow the United States Government. By Chansley’s own admissions to the FBI and news media, the insurrection is still in progress and he intends to continue participating.

Strong evidence, including Chansley’s own words and actions at the Capitol, supports that the intent of the Capitol rioters was to capture and assassinate elected officials in the United States Government. Chansley left a note on the Senate Chamber dais, where Vice President Mike Pence had been presiding over the session just minutes before, warning “it's only a matter of time, justice is coming.” When questioned as to the meaning of that statement, Chansley went on a lengthy diatribe describing current and past United States political leaders as infiltrators, specifically naming Vice President Mike Pence, former President Barack Obama, former Senator Hillary Clinton and U.S. President-elect Joe Biden as infiltrators involved in various types of wrongdoing. Although he stated his note was not a threat, the Government strongly disagrees.

Even used his hunger strike against him.

Even now, Chansley continues to demonstrate a refusal to conform despite personal hardship as a consequence. Chansley’s choice to refuse to eat because he is not provided an organic diet in custody is predictive of how he will behave if conditions of pre-trial supervision do not suit him. If released, numerous conditions will alter and affect his routine and set forth daily expectations by which he must confirm. Chansley will not comply.

His lawyer has been asking in public for Trump to pardon him. As I understand it, if Trump is convicted in the impeachment, he can't issue pardons related to the impeachment.

But also note that Trump can issue pardons in secret without making them public.

Dude turned himself in to maximize his Presidential pardon chances since he knows Trump is gone on 1/20/21. By saying the most outlandishly pro Trump stuff he hopes to use the media as his tool for panhandling for said pardon. I think the FBI is being cautious and not adding anything from Title 18 until Trump is out of the picture. I know at least sedition applies.

If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined under this title or imprisoned not more than twenty years, or both.

Congress was in session performing the lawful act of counting electoral votes and was stopped as a result of his (and many others) forceful interference.

Excerpts:

14. A review of open source photographs also revealed photographs of a person, who appears to be the same individual wielding the shield in the video referenced in the paragraph above, at a Make America Great Again (MAGA) rally, which occurred in Washington, D.C. on or about December 12, 2020. In one of those photographs, the individual who appears similar to the individual who broke the Capitol window with a shield was wearing a black short-sleeved t-shirt with yellow, consistent with the “Proud Boys” logo. In another picture from the MAGA rally, also available on open source, the individual was wearing a t-shirt with a logo consistent with the United States Marine Corps. Depicted standing next to this individual in the same photograph is another person wearing a helmet bearing what appears to be the logo for the “Proud Boys.”

15. Another video posted to social media shows someone who appears to be the same individual that broke the window of the Capitol with the shield, smoking a cigar inside the Capitol building. In the video, the individual states words to the effect of, “Victory smoke in the Capitol, boys. This is fucking awesome. I knew we could take this motherfucker over [if we] just tried hard enough.”

He wanted to kill Pelosi and Pence, and was planning to come back on the 20th to kill everyone he can.

17. W-1 stated that after the events at the Capitol as described above, he or she spoke to an individual he or she knows as “Spaz,” along with other individuals. W-1 stated that during that conversation, “Spaz” bragged about breaking the windows to the Capitol and entering the building. In a subsequent interview W-1 clarified that “Spaz” said that he used a Capitol Police shield to break the window. W-1 said that “Spaz” can be seen on the cover of many newspapers and recognizes him from those photographs. W-1 stated that other members of the group talked about things they had done during the day, and they said that anyone they got their hands on they would have killed, including Nancy Pelosi. W-1 further stated that members of this group, which included “Spaz,” said that they would have killed [Vice President] Mike Pence if given the chance. According to W-1, the group said it would be returning on the “20th,” which your affiant takes to mean the Presidential Inauguration scheduled for January 20, 2021, and that they plan to kill every single “m-fer” they can.1 W-1 stated the men said they all had firearms or access to firearms.

21. On January 9, 2021, FBI located a publicly available Telegram account username @KINGbehavior. The profile listed a display name of Spazzo 2nd°. The Bio stated: “Marine vet / boxer / patriot/ Proud Boy 2nd°.”

A man from Kentucky told the FBI that he and his cousin began marching toward the U.S. Capitol on Jan. 6 because “President Trump said to do so.” Chanting “Stop the steal,” the two men tramped through the building and snapped a photo of themselves with their middle fingers raised, according to court documents.

A video clip of another group of rioters mobbing the steps of the Capitol caught one man screaming at a police officer: “We were invited here! We were invited by the president of the United States!”

A retired firefighter from Pennsylvania who has been charged with throwing a fire extinguisher at police officers felt he was “instructed” to go to the Capitol by the president, a tipster told the FBI, according to court documents.

Several others made that claim, and some of them are trying to use it as a defense.
