Will Trump finally be indicted in Georgia?

Trump complains that if he is sentenced to prison, that he will likely die there. Boo hoo hoo hoo hoo :p According to what his fellow right-wingers like to say, if you don't want to do the time, then don't do the crime.
 
He should try to get sent to Federal Prison Camp Pensacola, considered the cushiest prison in the US. There's racquetball, volleyball, and horseshoes (not that Trump's fat ass is up for that), and movie night in the camp theater. Meals include a lot of hotdogs and pasta. If you're good you get phone and email privileges. Trump could donate a golf course to the place and write it off on his taxes. I picture him buying a cell block and charging rent to the Secret Service staying in nearby cells. Actually that's thinking too small. He'd make the whole place a privatized prison (Der Trumpenkerker, literally, Trump's Dungeon), bring in aides, valets, makeup artists, chefs, etc. God help 'em if there's a new covid strain, Trump will infect the whole joint.
 
Georgia judge declines to send Trump co-defendant in election fraud case to jail over social media posts

The judge overseeing the Fulton County election racketeering case declined Tuesday to send one of Donald Trump’s co-defendants to jail over recent social media posts and other comments he made targeting witnesses.

Judge Scott McAfee said that while the defendant, Harrison Floyd, made “technical violations” of his bond agreement, “not every violation compels revocation.”

Fulton County prosecutors asked Judge Scott McAfee to revoke the bond for Harrison Floyd, arguing that he’s violated the terms of the agreement meant to keep him out of jail because of his alleged “effort to intimidate codefendants and witnesses.”


Fulton County District Attorney Fani Willis personally argued the case Tuesday, the first time she has appeared in court for a pre-trial hearing in the sprawling election subversion racketeering case.

“What we are really here to decide today is does this order mean something or not. He does not get an ‘oh, I’m sorry,’ after I’ve already intimidated the witnesses in this case,” Willis said. “It is too late.”

Had McAfee granted prosecutors’ requests, Floyd would have been the first defendant to be jailed for their actions related to the case – a move that would have sent a strong message to the other defendants that prosecutors are closely watching their public maneuverings as the criminal case unfolds.
 


Fulton County DA Fani Willis has filed a new court paper declaring that open hunting season on the DA’s office is OVER and firing back at her critics, and bringing receipts to embarrass her enemies. Michael Popok of Legal AF reports on DA Willis informing the court that the lawyer who brought the motion to disqualify and dismiss the indictment has been untruthful to the court and has filed a bad faith motion.
 
Well I hope it shuts it down, because it would seem absolutely awful that an asterisk lets Trump get away with mob bossing the GA SoS over the results of an election.
 
Judge dismisses some Trump Georgia election subversion charges but leaves most of the case intact

The presiding judge in the Georgia criminal case against Donald Trump and his allies has thrown out some of the charges against the former president and several of his co-defendants.

The partial dismissal by Georgia Superior Court Judge Scott McAfee leaves most of the sprawling racketeering indictment intact.

McAfee ruled that six charges in the 41-count indictment related to Trump and some co-defendants allegedly soliciting the violation of oath by a public officer lacked the required detail about what underlying crime the defendants were soliciting.

Trump was named in three of the counts specifically, meaning the former president is now facing 88 charges over the four criminal indictments in Georgia, New York, Washington, DC, and Florida.

An observation that women involved prosecuting in the Trump cases are wining. I haven't looked at all the 90 plus cases - GA NY - go get him ladies.

They contend the ruling doesn't go far enough by just forcing out special prosecutor Nathan Wade.

Willis and Wade admitted to having an affair, but contended that Willis did not improperly benefit from having hired Wade to oversee the case against Trump and 14 others accused of illegally conspiring to overturn the 2020 election in Georgia.

Trump lawyer Steven Sadow said the nine are seeking to disqualify Willis and the entire DA's office, which was the basis of an initial motion filed with Fulton County Superior Court Judge Scott McAfee on Jan. 8. The defendants alleged Willis had a "clandestine" affair with Wade, the private lawyer she hired to manage the case and took vacations with him that created a professional conflict of interest. McAfee let Willis stay on the case, as long as she forced out Wade to preclude any appearance of a conflict of interest going forward.

The judge said the appeal can go through. More delay.
I think he's not stopping the trial for this appeal though. At least that's what I heard.
 
Trump loses bids to dismiss classified docs, Georgia election cases
That ruling came about two hours after Fulton County Superior Court Judge Scott McAfee denied Trump’s attempt to dismiss his Georgia election interference case on the grounds that it violated his free speech rights.

“The State has alleged more than mere expressions of a political nature,” Fulton County Superior Court Judge Scott McAfee wrote in a 14-page ruling on Thursday.

But McAfee said Fulton County District Attorney Fani Willis alleged that Trump’s conduct went beyond merely protected speech. Rather, she charged him and his allies with lying to government officials and filing knowingly false documents that influenced the actions of state and federal officials.

“The defense has not presented, nor is the Court able to find, any authority that the speech and conduct alleged is protected political speech,” McAfee ruled.

Trump’s attorney Steve Sadow said the former president and his co-defendants “respectfully disagree with Judge McAfee’s order” and are weighing appeal options.

Interestingly, this is itself an attempt to politicize his criminal speech.

Contempt of court is a crime. Intimidating witnesses is a crime. Perjury is a crime. Fraud is a crime. All can be achieved with no actions by the criminal other than speech.

Not all speech is protected by the First Amendment.
