Speaking of the Nuge, where is he? You'd think he be right up in this. Maybe like in his Viet Nam days he's still a chicken hawk.

A second vehicle — which contained Ryan Bundy, Ryan Payne, Shawna Cox, Finicum and an unidentified 18-year-old woman — went around their stopped comrades’ vehicle but ran into a blockade about a mile away.

The bodyguard said Cox and Payne each told him that Finicum charged toward officers before he was shot, and he explicitly denied that the rancher had surrendered or complied with law enforcement.
“He was not on his knees, none of that,” McConnell said. “He was none of that nonsense. You know, that was a miscommunication on somebody else’s part. But he went after them. He charged them.


So the lies and the myth making are already overtaking the facts and the truth of the matter.

There appears to be conflicting accounts at this point.

UPDATE: New details emerge about LaVoy Finicum’s death: ‘He’s like just shoot me — and they did’

Sharp said he got out and dared authorities to shoot him as he approached with his hands raised. “He’s like, just shoot me then, just shoot me — and they did, they shot him dead,” Sharp said. “They shot him right there, he was just walking — I saw it. I swear to God, he was just walking with his hands in the air.”

Sharp was in the car. Perhaps what she described the others would call charging at the officers.
 
no fear of imminent death is threatening, plus failure to comply has worked out to be lethal before

According to the feds, they were pulled over at a traffic stop and told to surrender. Most of them did.
According to Ammon Bundy, he was already in the back of a police car when he saw the dead guy raise his hands over his head in surrender, when they shot him in the face. At least, that's what some patriots are saying his wife says he texted to her from the back of the police car. Some of the patriotic websites are calling these third-hand accounts 'eyewitness' accounts of 'the murder.'

So, the guy who said he'd rather die than go to prison either lied about his statement and was surrendering when they killed him, or Ammon Bundy may not have had the best view of what was going on as they tried to get the last guy out of the car.

Seems odd that if they were intending to MURDER these patriots for daring to stand up for their rights, that the feds only killed one guy. You'd think they could arrange an effective escape attempt and shoot them all.

As law enforcement moved in on Wednesday to contain militants who have occupied the Malheur National Wildlife Refuge for weeks, a broadcast from insid the refuge showed angry militiamen promising a “bloodbath.”

A live video feed from the DefendYourBase YouTube channel, showed several militants operating a large excavator. At least one of the militants was dressed in military-style gear and carrying a rifle.
“The media has been ordered to leave, and that means they are coming to kill us and they don’t want them to see that!” the man yelled into the camera. “They’re going to murder all of us and the media are cowards.”
“The media has been waiting for a bloodbath this whole time we’ve been here!” he exclaimed. “Now, there’s going to be one and they’re told to run? Because the feds don’t want them to know who is murdering us!”
Continuing to shout into the camera, the militia member called for the American people to join his cause: “Right now, it is on!”


The crazies simply aren't going to peacefully surrender it seems.

Lets assume it's a correct description:

He had not surrendered. Hands up is not enough--surrender also includes compliance with orders.

A hostile walking up to you with his hands raised can still snatch a weapon.

Three more arrested. Five more released. The Revolution has sprung a leak. Nobody else cut down in a hail of guvment gunfire as predicted by various squalling drama queens.
 
Speaking with OPB Wednesday night, militant David Fry said five people remained in the occupied refuge. He said that he personally had no plans to leave at this time.
When asked about Bundy’s call to leave the refuge, Fry said, “We have new leaders now and new plans.”
