Bertelsman disagreed: “This is not supported by the plain language in the article, which states none of those things… [The article] cannot be reasonably read as charging Sandmann with physically intimidating Phillips or committing the criminal offense of assault,” he wrote.

I understand the basis of the Judge's ruling. Basically the WaPo, when they referred to the kids as racist, were quoting the Native who confronted them. He is the one who made the false statements, they only quoted him.

So now, if you want to say something untrue and get away with it, find a homeless person. Give him $5 and a bottle of booze, and ask him to say something bad about someone. Then quote him over and over and over...

You have to agree with Derec's implication, though, that a Trump appointed judge probably would rule in favor of a MAGA hat wearing punk based on opinion (protected by the First Amendment) simply being reported as exactly that and not as the statement of WaPo itself.

The MAGA hat is evidence. It’s mitigated by his youth, sure. The videos certainly showed him apparently in the face of an older man, with a smirk on his face. Now a lot of teens have resting smirking face, that is true. But then, there’s the $250 M lawsuit levied at one of the many news outlets that reported on the incident. That was kind of an asshole thing to do. As far as it being motivated by the horrors that such fame has given the boy, I had pretty much forgotten all about the incident along with 99.5% of the rest of America. The lawsuit was always a non-starter. But it did put the kid in the news again—and was an attempt at chipping away at the public’s confidence in the news media, especially the media which is generally not very favorable towards Trump.
