Freddie Gray dies a week after being injured during arrest

BALTIMORE —Baltimore City State's Attorney Marilyn Mosby on Thursday announced a grand jury has returned indictments against all six officers in Freddie Gray case.

Makes me wonder if there is pretty strong evidence. Will a plea deal follow?
 
Should the prosecutor face murder charges? If she hadn't been so reckless Freddie would be alive today.

In his March 17 email to Robinson, Rosenblatt wrote that Mosby's office wanted to build on success reducing crime in the West Baltimore neighborhood through the Operation Ceasefire program, specifically by "targeting that intersection for enhanced prosecutorial (and hopefully police) attention." In that program, prosecutors, police and community members work together to convince criminals to reform.

On March 20, Robinson forwarded Rosenblatt's email to several officers in the Western District — including Lt. Brian Rice. He was one of the three officers who arrested Gray and one of the six later charged in Gray's arrest and death.

Robinson told Rice and the other officers to begin a "daily narcotics initiative" focused on North and Mount, according to the email, and said he would be collecting "daily measurables" from them on their progress.

"This is effective immediately," Robinson wrote, noting the officers should use cameras, informants and other covert policing tactics to get the job done.

Damn that Mosby has such a depraved heart.

The defense is using the kitchen sink tactics (at least in the media). Asking that police crack down on vice is different than telling the officers to give small time offenders a rough ride.

Today, Mosby, through a spokeswoman, said, "We have not received the motion. If such a motion was filed, we will respond in due course. Consistent with our prosecutorial obligations, we will litigate this case in the courtroom and not in the media."

So the motion to remove her from the case was never filed?

Freddie Gray suffered a single "high-energy injury" to his neck and spine — most likely caused when the police van in which he was riding suddenly decelerated, according to a copy of the autopsy report obtained by The Baltimore Sun.

The state medical examiner's office concluded that Gray's death could not be ruled an accident, and was instead a homicide, because officers failed to follow safety procedures "through acts of omission."

Though Gray was loaded into the van on his belly, the medical examiner surmised that he may have gotten to his feet and was thrown into the wall during an abrupt change in direction. He was not belted in, but his wrists and ankles were shackled, putting him "at risk for an unsupported fall during acceleration or deceleration of the van."
 
"Most likely", "surmised" - it sounds like the ME is saying that actually he has no idea what happened and it's most probable that Gray committed suicide.

I think he's trying to say:
1) Freddie Gray was faking his injuries
2) This one Black man faked it so Freddie obviously did
3) The autopsy is not exonerating the police, so here is a distraction.

I think the argument is going to be that it was reasonable for the police to think that Freddie was faking because those people always do that, acting a fool and all that. Therefore the police shouldn't be charged. It was okay for them to ignore his injuries.

The flaw in that is that the driver would have (or reasonably should have) known that some injury was likely after the ride and other officers should not ignore please of pain whether they think them fake or not.

Unfortunately, it's not "beyond all reasonable doubt", the standard required for a conviction. A defendant in this country isn't required to propose another story, just cast doubt on the specific allegation.

Good point! We completely forgot that we had a judicial system. We thought that Obama would just pronounce the white officers guilty and behead them himself.

If these cops don't get convicted, are you saying everyone will simply say "gee, I guess we have a judicial system that requires guilt beyond all reasonable doubt, a very high hurdle to overcome." Or will they accuse the process of being racist? Is the medical examiner a racist for using language such as "likely" and "surmised", which are words that leave enough wiggle room to make a conviction much more difficult?

No, but if the ME had said "Fo' shizzle, them homies capped that negro", it could have been viewed as his having used somewhat racist language.

Are you familiar with autospy reports, "likely" is a much stronger term than "could have". Are you seriously reading that as hedging ones bets? It reads to me that it slides inside the threshold of reasonable doubt.

Jebus, never have conservatives cared so much about the principle of reasonable doubt. This trial is in no way going to be about the ME report. It is going to be about plausible deniability. Only the most ardent of racists this the ME report doesn't conclude that the guy died due to injuries sustained while in custody. The officers need to show that they simply err'd and didn't know.

I think you're reading too much into this. The coroner has not mentioned any other causes of injury or death.

The point is that he just collapses with no trigger. He's pretending to be hurt when he isn't. That sort of person might have gone further to fake injuries and accidentally gone too far.
