The judge overseeing Donald Trump’s federal election subversion criminal case has reinstated the gag order she issued on the former president earlier this month.

US District Judge Tanya Chutkan also denied Trump’s request to issue a long-term stay of the order – which bars the former president from publicly targeting court personnel, potential witnesses or the special counsel’s team – while his appeal of it played out.

“As the court has explained, the First Amendment rights of participants in criminal proceedings must yield, when necessary, to the orderly administration of justice—a principle reflected in Supreme Court precedent, the Federal Rules of Criminal Procedure, and the Local Criminal Rules,” the judge wrote. “And contrary to Defendant’s argument, the right to a fair trial is not his alone, but belongs also to the government and the public.”

Special counsel accuses Trump legal team of trying to manipulate courts with requests to delay trials

Prosecutors with special counsel Jack Smith’s office have accused former President Donald Trump’s legal team of seeking to manipulate the courts in their bid to delay his trials past the 2024 presidential election.

Fresh off a Florida hearing where Trump appeared to gain traction in his effort to delay one of his criminal trials, his attorneys asked Wednesday night for a second trial he faces next year in Washington, DC, to be put on hold.

But Trump’s emboldened attempts to delay facing federal juries – on his national security records mishandling and 2020 election cases – while he is running for president were quickly called out by prosecutors who accuse him of manipulating the courts.


“Defendant Trump’s actions in the hours following the hearing … confirm his overriding interest in delaying both trials at any cost. This Court should [not] allow itself to be manipulated in this fashion,” the Justice Department said in a court filing Thursday with Judge Aileen Cannon in Ft. Pierce, Florida.

Trump has long wanted to prevent his criminal trials from happening before the election next year, and his attorneys in recent days have emphasized that their work on the cases and other legal matters for the ex-president require more time.

In a brief order, a three-judge panel at the US DC Circuit Court of Appeals said they were pausing the gag order issued by District Judge Tanya Chutkan to give them more time to consider Trump’s request to pause the order while his appeal plays out before the court.

The appellate judges – Patricia Millett and Cornelia Pillard, both Barack Obama appointees, and Brad Garcia, a Joe Biden appointee – said they would fast-track Trump’s appeal of the gag order and hear arguments in the matter on November 20.

Federal prosecutors want Trump gag order upheld, pointing to attacks on special counsel’s family

The Justice Department on Tuesday urged a Washington, DC, appeals court to uphold the gag order against Donald Trump in his federal election subversion criminal case, saying the former president’s recent attacks on special counsel Jack Smith’s family underscore why restrictions on Trump’s speech are necessary.

“There has never been a criminal case in which a court has granted a defendant an unfettered right to try his case in the media, malign the prosecutor and his family, and … target specific witnesses with attacks on their character and credibility,” Smith’s team told the US DC Circuit Court of Appeals in a filing.

Trump is asking the appeals court to undo the limited gag order issued last month by District Judge Tanya Chutkan. The former president has already failed once in his bid to undo the gag order, and the appeals court is set to hear oral arguments on the matter next week.
 
Special counsel to use Trump’s continued embrace of January 6 rioters against him at trial

Special counsel Jack Smith plans to present evidence at Donald Trump’s federal election subversion trial next year that his continued support for US Capitol rioters helps to show he intended to inspire violence on January 6, 2021, as part of a conspiracy he led to overturn the 2020 election.

In a court filing made public Tuesday, prosecutors point to Trump endorsing the Proud Boys during a 2020 presidential debate, saying he would pardon January 6 rioters and playing a recording of the National Anthem from imprisoned January 6 defendants at a campaign rally.

The filing goes further than the indictment against Trump by tying him directly to the rioters. Trump has been charged with conspiracy and obstruction. He has pleaded not guilty. The trial is scheduled for March in Washington, DC.

Prosecutors say the fact that Trump has financially supported – and celebrated – January 6 rioters establishes his motive and intent to commit federal crimes.

“The Government plans to introduce evidence at trial showing that in the years since the January 6 attack on the Capitol, the defendant has openly and proudly supported individuals who criminally participated in obstructing the congressional certification that day, including by suggesting that he will pardon them if re-elected, even as he has conceded that he had the ability to influence their actions during the attack,” prosecutors wrote.
 
The jury selection process has begun. Questionaires have been mailed out to prospective jurors.
 
I heard about this today from MSNBC. There was some talk of protecting jurors from various attempts to intimidate them with threats and attempts to contact them by GOP operatives. And then I thought, it may be good to worry about fear causing a holdout juror. But that could backfire. Anonymous deathreats etc might cause a juror to think "Fuck you!" and take it out on Trump. "Guilty! (You vicious bastard!).
 
Special counsel goes directly to Supreme Court to resolve whether Trump has immunity from prosecution

Special counsel Jack Smith on Monday asked the Supreme Court to decide whether Donald Trump has any immunity from criminal prosecution for alleged crimes he committed while in office – the first time that the high court will weigh in on the historic prosecution of the former president.

The extraordinary request is an attempt by Smith to keep the election subversion trial – currently scheduled for early March – on track. Smith is asking the Supreme Court to take the rare step of skipping a federal appeals court and quickly decide a fundamental issue of the case against Trump.

Smith’s team has asked the court to review district Judge’s Tanya Chutkan ruling that as a former president, Trump is not immune from the election subversion prosecution case brought in Washington DC. Lawyers for the former president have argued that Trump’s alleged actions over the 2020 election results were part of his official duties at the time and therefore he is protected by presidential immunity.

Prosecutors also asked the court to decide whether Trump is protected by double jeopardy. Defense lawyers have asserted that because Trump was acquitted by the Senate during his impeachment trial that he cannot be criminally tried for the same alleged actions.

Later Monday, the Supreme Court said it will expedite consideration of Smith’s petition to rule on the question of whether Trump deserves immunity. Trump has until December 20 to file a response.

Generally SCOTUS hates setting bad precedent, but since Bush v Gore II (Rumble in Florida), they've been able to look the other way, or create ham fisted rulings that rely on hyper-technicalities to cover their political bias.

To say the President is immune from anything as President, while not President would be a particularly crazy thing. We know 2 or 3 justices will rule a GOP'er in office can do whatever the heck he wants. So that leaves needing 2 of 3 of the remaining strongly conservative justices. I could see them saying the state can't do this, but this is the Justice Department doing it. If the Justice Department or Congress has no authority over the President, it declares him a King. There is no other way to look at it. If Trump shoots some guy when he is President, there is no limitation to that action?

Sadly, there is one easy solution and that is Congress's impeachment power, but the GOP are authoritarians who want to turn this country into a one party dictatorship. And they failed.

Perhaps SCOTUS's best avenue is to say they can't say, and interceding the Prosecution from the Executive or Legislative Branch would be a violation of separation of powers. However, as I note, Congress is much more suited for this via impeachment. Don't take my word for it, ask Mueller.

Pretty much. But Biden writes an executive order saying he has full authority over who succeeds him regardless of what the Constitution says. And then he gives it to Hunter and Trumptards can't do a fucking thing about it because immunity bitch!
