People who are drunk are in greater danger of a lot of things such as getting run over, getting robbed, raped and attacked, losing their keys and wallets etc because they are less likely to defend themselves and less aware of their surroundings. It doesn't minimise the gravity of any perpetrators against them.
 
Some things that are kind of related to this are what I have seen reported about a growing ladette culture where women drink as much as men. Maybe this retiring judge is offended by it happening. Not women having one or two "dainty drinks" in an evening.

Another is about that some people just can't stop at a couples drinks and despite intending just that much get extremely drunk.

If you had a woman (or a man in the case of getting robbed or assaulted) who intended to have two drinks, but had 6-7 once buzzed and then had friends not be around, this is a tough situation.

If you had a guy who was really drunk and decided to sleep it off in the back of his car (ignoring that can be a DUI) but also forgot to lock the rear door (keys at his feet on the seat) and someone drug him out and then stole his car. Does he have any blame? Would his insurance company try to not pay for the incident?

Can we cast any blame on the still sober man for not planning ahead for when he was very drunk?

At any rate, prosecute any person who assaults or rapes a drunk person to the normal or even greater extent for when the victim is sober.

Thanks for letting everyone know that you hate feminists and that you think there are certain conditions under which you feel women deserve to be raped.

Obviously, you feel that women deserve to be raped if they are drunk.

As you went out of your way to tell us how much you hate feminism, I can therefore surmise that you do not think men deserve to get raped when we get drunk.

So let's explore this a little further, shall we?

If a woman dresses in ways that you do not approve of, does she deserve to get raped? What is the equivalent thing a man can wear that would cause him to deserve to get raped by a gay man or a straight woman?

What sort of behavior do you feel causes women to deserve to get raped? If men behave the same way, so we deserve to get raped by gay men or straight women?

Under what other circumstances do you feel women deserve to get raped?

And what punishment do you feel should be given to feminists like me who have a moral problem with your disgusting assumptions about how the world should work?
 
So hypothetical:

Let's say you get really drunk and happen to walk past the gay part off town. Do you deserve to get raped by any gay men who happen to encounter you while you are dunk?

If not, why not?

I think the judge was calling for caution for drunk people can be easy targets for attacks of all sorts. No doubt a few Femi-Nazis got a bit excited over this.

I agree with the commissioner, this is victim blaming. We see it all the time in college sexual assault cases, one of the first questions is "how much did you have to drink?" Granted they want to establish incapacity, but it is often used to shame the survivor into silence.

Not the judge's place to do from the bench. The judge was there to sentence the rapist; not to lecture the victim - and by extension - every other woman
 
I think the male rape thing is the key here. A guy gets raped, I doubt people would be asking if he was drunk.

You are blaming the victim for reckless behavior that was 'partially responsible' for a crime committed against them.

Really, what this is saying is women shouldn't drink with men, because it doesn't offer a BAC that is okay where women don't have to worry about the drinking crossing the border from completely fine to wildly reckless. So women, don't drink near men. Otherwise, you might get raped.

I think Judge Lindsey Kushner seems a very sensible person unlike most of her critics. Still, maybe it's just me. Maybe it's because I take what she said at face value rather than as a license to misrepresent her views. It would have been bad if she had in any way blamed the victims of rape for getting drunk in the first place. But she hasn't. And I think it's a very good idea that she should alert people to the risk factors. It is equally important to teach men how to behave and to reduce the number of victims of rape.

To be fair, Judges quite frequently use the bench to give us their opinions, as if we should care what they think about anything other than legal matters. It's hardly unique to this case.

But judges and people that work in law in general tend to be insufferably self-absorbed and have inflated senses of self importance.
