Pentagon to investigate Sen. Mark Kelly for anti-Trump video

The unprecedented move comes after the retired Navy captain advised troops they don’t need to obey unlawful orders.

The Pentagon on Monday announced it is investigating Sen. Mark Kelly, a critic of President Donald Trump and Navy veteran, after he and fellow Democrats advised troops not to follow illegal orders.

The Pentagon, in a post on X, said it had launched “a thorough review” into Kelly for “serious allegations of misconduct,” which could result in recalling the Arizona senator to active duty to court-martial him.

Kelly, in a statement, dismissed the investigation. “If this is meant to intimidate me and other members of Congress from doing our jobs and holding this administration accountable, it won’t work,” he said. “I’ve given too much to this country to be silenced by bullies who care more about their own power than protecting the Constitution.”

Administration officials have previously floated the idea of recalling retired military personnel to active duty to face court martial for alleged crimes.

Former Joint Chiefs Chair Gen. Mark Milley, who sparred frequently with Trump during his first term in office, said he worried he would be charged with treason or sedition by Trump as revenge for their past disagreements.


But Kelly’s status as a U.S. senator could complicate the Pentagon’s investigation because the Constitution explicitly shields members of Congress from White House overreach, said Anthony Michael Kreis, a constitutional law professor at Georgia State University.

“Having a United States senator subject to discipline at the behest of the secretary of defense and the president — that violates a core principle of legislative independence,” Kreis said in a phone interview.


Charlie Swift, a lawyer and a retired lieutenant commander in the U.S. Navy, said that in his view the lawmakers in the video made a “true statement of the law” when they said troops should refuse illegal orders.

Mr. Kelly’s statements are also probably protected by the speech and debate clause that protects members of Congress from prosecution, Mr. Swift said.

Honestly, what sort of Americans are not at this point done with Trump? What else could he do, to more thoroughly disgrace the office he holds? The poop plane video...Quiet, Piggy...stating that telling the military to obey the law is sedition. I just, don't, get, it. But of course these are the same people that don't care about the scandals of the past, the true sedition of allowing the Jan. 6 rioters to rampage, the theft of government documents, the conviction as a sex offender and business fraudster. They deserve a horrible President. The rest of us don't.

Of course, when they say the Pentagon, they mean Pete Hegseth. If it was actually the Pentagon doing any investigation it would be Trump and his cronies being investigated. Of course, there is also the issue of what the Pentagon can investigate, and surely this should be a civil matter, not military, as these people are not current military (many of them are former military which makes their statement authoritative, as they have expertise on the matter of UCMJ).
