Tennessee Fucks Up

Livestream! That's a twist. Oh, dear. Barbarity is escalating

Now that a date has been set, the appeals process can begin. This will take years.
Whatever happens, Hegseth won't be in office when it does.

I disagree. Kegsbreathe is the perfect idiot Trump wants.

If we’re lucky, he’ll be in front of the firing squad.

Why doesn't Hegseth not just double down and make it a public beheading at Neyland Stadium.

So now Hegseth is saying that Hasan's execution will be public and be live streamed!!!

I mean holy shit! Livestreamed? WTF?

He's also inviting Jihadi's to come to Texas that day. What a coup that would be for some Islamic terrorist to attack that area at the same time. It would be insane.

I also did some further research and while a proper firing squad destroys the heart resulting in an instantaneous loss of blood pressure in the brain, you've got enough reserve oxygen to know what's happening to you for about 10 - 15 seconds. Survivors of chest gun shot wounds (obviously not in the heart) describe a massive body blow hitting you as opposed to a sharp penetrating pain. The pain does come a little while later. So he probably feels a huge body blow, and then maybe slowly blacks out while realizing he's dying. I don't know.

The guy is paralyzed from the shooting incident. Are they really going to wheel him out in public and shoot him like a dog? Does hegseth not realize the optics of that will look fucking awful. Seriously. This guy is fucked up. The Feds have the drugs to put him down like a normal lethal injection. Just do it and be done with it. Sheeesh!!!

Furthermore, this is going to result in a large round of appeals and further delay in his execution as a result. If they stuck to Lethal Injection, it would happen on schedule with little chance of any kind of appeal being successful.
If they stick to lethal injection he would probably survive.
You yanks are best with guns. Stick to your strengths.

Shhh, we're not supposed to talk about stage 5 until we've gotten away with stage 3.
Don't be fucking stupid. Stage 5 is when convicted criminals can earn their freedom if they agree to participate in a cat and mouse like game where they are hunted.
The forum won't let me laugh and cry react on the same post. What fucking times are we living in that I was afraid your link was to an actual news story?

What's even more depressing is that it's possible I'm 6 months ahead of an idea this fucking administration will float.

Even if its military?
I have absolutely no idea. The military isn't exactly the US Judicial system, but there are rules. I have no idea what they are and how they apply.

I've got to think the live stream portion of it is extraordinarily problematic. I hate how the Trump Admin is normalizing lying, hate, and cruelness. Outside of being family of a victim, no one should want to be a witness to an execution.

The military is indeed the U.S. Judicial system and in Hasan's case, it's really just getting ramped up. If the execution happens within 5 years, that would be a quick one. It definitely won't happen December 3rd - unless Hasan waives all appeals, which he could do.

But at this point, Hasan's case has only gone through a military review. That took almost 10 years! Now the federal district courts will step in and the first step will be to file a petition for habeas corpus. If that's filed, an automatic stay will be given. It will take at least 6 months to a year or more for the district court judge to complete his review. Then his decision will be appealed to a federal circuit court of appeals and those typically take two years to get a full decision. Then it will go to the supreme court, which will likely decline the case. But even that will take months. At that point a new execution date will finally be set. But that won't necessarily end the matter as there can be other rounds of review. Bush signed the execution warrant for another military prisoner, Robert Gray, 18 years ago, and the matter still hasn't been resolved. Death is different.

Bottom line is that there is no way it will take place before Trump is out of office. (well, assuming the son of a bitch gives up power.) Hegseth will be gone then too. The only way this happens quickly is if Hasan gives up and opts for the martyrs death. Which is a distinct possibility.

You know, I really wish the Radical Left would listen to me, sometimes. Tenessee fucked up, sure, but this may be literally the worst possible case to lean on as the exemplar of why the death penalty is wrong. The Fort Hood guy, second. There's a reason the Trumpists have chosen these specific people to be the flash points for the newest voting season distraction culture war. No one in "the political middle" is going to read Christa Pike or Nidal Hasan's Wikipedia page and think "wow, the hippies are right, this Satanist who slowly tortured a teenager to death and kept her skull in a coat pocket and this traitorous soldier turned mass-murderer really deserve a second chance." You have to already have a strong anti- position on the death penalty for that to make sense.
The most successful argument I've run across for my own views is that LWOP actually costs the taxpayers less than execution. But it really truly needs to be without even the possibility of parole. Some people cannot be rehabilitated, and it's reckless endangerment to release them.

True.

And I maintain that capital punishment is barbaric, whether or not it s successful.

But it makes sense to me to do as (I understand) China does, and save lives with the organs of executed criminals.

People are dying for lack of a transplant while viable organs are being buried or cremated.

It opens the path to all sorts of corruption, but what doesn't?
Are executed criminals no allowed to be organ donors?
Or are you proposing that they get no say in whether their organs get used?

Sorry, it's just not clear to me.

My question is, why in the fuck would you do that to someone? I mean the shooters. The guy committed a serious crime. There is no doubt of guilt. And he was military, so this seems like a rather hard to argue against death penalty case.

But why firing squad? Hegseth get hard over the prospect of it?
UCMJ allows for hanging, firing squad, and lethal injection.

Realistically, firing squad is probably the most efficient and cost-effective means. Very little in the way of suffering, and bullets are cheap.

There will be an automatic stay issued the moment he files a Habeas Corpus petition in federal court.
This isn't a federal court case, it's UCMJ.

That said, I think there's like one automatic appeal that occurs when the capital punishment is sentenced. I dunno. Needs more research.

Oddly enough, by botching the execution, Tennessee may have made her release a lot more likely than it otherwise would have been. No Tennessee judge would ever have considered letting this woman go. Her crime was outrageous, and she sealed her fate even further by getting in potentially homicidal incidents while in captivity. But if she is deemed unable to understand her punishment now, she won't be executed at the very least, and the likelihood of some sunset years release is much less implausible.

FYI, you are asking clarification from someone who lives in a country that recognises the death penalty is some fuck arse bullshit cunts masturbate to.

But it really truly needs to be without even the possibility of parole.
Why?
Some people cannot be rehabilitated, and it's reckless endangerment to release them.
Sure. But how can you know who those people are, at the time of sentencing?

Surely it makes more sense to repeatedly assess their suitability for release, and to parole them if (and only if) they display such suitability?

To deny in advance the possibility of parole is as (literally) prejudicial as to impose a mandatory sentence in legislation. It removes, from those qualified to make a judgement on a specific individual case, the right to exercise that judgement, and passes that right to some legislative body that cannot possibly have access to the facts, or to a court that cannot possibly know a given prisoner's future.

To say "This person is currently a danger to society" may be reasonable, but to add "and always will remain so, until death" is not. It is a claim about a distant future. Nobody is able to justly make such claims.
