Birthright citizen ship was
targeted by Trump's EOs. They indicated that the parents must have legal standing for offspring to have birth related citizenship.
The trouble is, that isn't the law. And there is some pretty messed up logic here. After all, SCOTUS ruled in Roper that the Executive Branch isn't allowed to interpret anymore... it must be explicit in the legislation. We are talking the Fourteenth Amendment, which is explicit. And SCOTUS has back up birthright citizenship.
So we start wandering into what is the world of Trump. Say whatever you want and stick with it. So Trump's Executive Branch has said they refuse to follow the rules as set forth by Congress (pre-14th Amendment) and SCOTUS. I find this more troubling than the actual policy because it is a continuation of Trump will rule apparently as he sees fit, and the law doesn't matter. He says he won't enforce the TikTok ban. He won't enforce birth right citizenship. These are laws / and or the Constitution explicitly. He swore to abide by the rules, and he is already breaking them.
Granted, I can see SCOTUS pull out of the hat and reverse birth right citizenship too, but we aren't there yet.
