You should really take that up with the people that wrote and enacted the 14th ammendment.

"No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability."

I remember a few years ago she got dragged into the anti-vaccination nuttery, because of an episode of The Brady Bunch from 1969 where she got measles and said (paraphrasing) that measles is no big deal. There is a question of 14.3's applicability to the presidency and vice-presidency. Note that their electors are mentioned, but they themselves are not. That is a curious difference with Article II, Section 4 where both are mentioned explicitly with regard to impeachment.
Also, 14.5 explicitly gives power to enforce provisions of the 14th Amendment to Congress. That includes defining what constitutes an "insurrection". Neither state courts nor state SecStates are given that power by 14.5.

In the end, the issue will have to be decided by SCOTUS.

in the absence of a federal law it would seem that state law would hold and that was followed quite well in Maine for example.
In the end, the issue will have to be decided by SCOTUS.
I think everyone agrees on that. Hard to believe they wouldn’t take this on.
