Cuz it's pretty much guaranteed Biden would lose. Confidentiality of pretrial documents is well established legal concept. People have gone to jail and websites have been taken down for violating confidentiality rules.

Yes, I want politicians to do whatever they can, exhaust every avenue, to release those files. That includes appeals they know they will lose so they can say they made the attempt as they move to the next option. It will build stronger justification in the long run. "See, I tried this and was blocked, so now I am trying that" makes more sense than "I didn't even bother trying this before trying that."
