Probably the warning should be there, given that we are a litigious society that seems to need a lot of laws protecting us from ourselves. On the the other hand, if you have an allergy, shouldn't the responsibility be on you to know at least the most basic things that contain that allergen?
I had another thought. Shouldn't such products have warnings in all languages? How do we protect non-English speakers with milk allergies from digesting milk products? Can they sue the company if they have an allergy attack and claim they weren't properly warned?

No. Should the penalty for failing to warn people that butter contains milk be (a) a $25 fine and an order to correct the problem on future packages, or (b) an order to destroy 80,000 pounds of butter?
